The paper presents different clustering approaches in legal judgments from the Special Civil Court located at the Federal University of Santa Catarina. The subject is Consumer Law, specifically cases in which consumers claim moral and material compensation from airlines for service failures. To identify patterns from the dataset, we apply four types of clustering algorithms: Hierarchical and Lingo, K-means and Affinity Propagation. We evaluate the results based on the following criteria: entropy and purity; algorithm's ability in providing labels; legal expert’s (...) evaluation; and experimental complexity. The results demonstrate that the most advantageous approach is Hierarchical Clustering, since it has the best entropy and purity numbers, as well as the least difficulty for the expert to analyze the clusters, and the least experimental complexity. The main contribution of the paper is to show the advantages and disadvantages of each approach, especially to identify labels in unstructured and non-indexed legal texts. (shrink)

Los pueblos originarios que habitaban —y habitan— el territorio actualmente ocupado por el Estado argentino han sido objeto de una serie de procesos simultáneos de desposesión, discriminación y pauperización. No obstante, con el paso de las décadas y en el marco de la lucha que los primeros llevaran a cabo, el gobierno ha adecuado parte de su legislación a los requerimientos internacionales en relación con el respeto debido hacia los derechos de todos los pueblos. En ese marco, la ciudad rionegrina (...) de San Carlos de Bariloche —principal núcleo urbano del territorio provincial— fue declarada formalmente como Municipio intercultural en 2015. Sin embargo, a pesar del pronunciamiento oficial y del compromiso exigible a los dirigentes locales, algunas situaciones dan cuenta de una aplicación superflua y acotada de la normativa, así como, también, de la pervivencia de una historiografía conservadora que incide con efectos reaccionarios en el accionar de los funcionarios. Puntualmente, en base al análisis de circunstancias específicas bajo el marco intercultural de la legislación local vigente, el presente artículo se propone precisar falencias en el accionar del Municipio para dar cuenta de una postura vaga respecto del acompañamiento y salvaguarda de las comunidades mapuche. De esta manera, sin pretender que lo intercultural se agota en la relación pueblos originarios/Estado, el objetivo es encender una luz de alerta que motive un accionar superador por parte de quienes ejercen —y ejerzan— la función pública en la ciudad, bajo la convicción de que es necesario reivindicar los derechos del pueblo mapuche a su propia historia, territorio e identidad, todos ellos derechos humanos garantizados por la legislación internacional para todos los habitantes del planeta. This article studies natural food packaging as enabling artifacts of the traditional material culture of Antioquia in Colombia. For this purpose, we consider artifacts as objective nodes that combine design and use intentions, functions, materials, histories, artifactual lineages, and cooperative relationships that stabilize ritualized practices of a human group. We take the example of natural packaging as artifacts that enablers and stabilizers of traditional cooking and food preparation practices. Natural packaging materials are here assumed to be leaves having some favorable (...) property to contain a food product. After providing a theoretical reflection, we analyze the data collected from fieldwork we conducted in two towns in Antioquia, Colombia (Santa Fe de Antioquia and Amagá), as well as from an interview with an expert in the field. Finally, we show that it is possible to postulate an analysis under a relational ontological description of a traditional practice with conceptual categories of the philosophy of technology. Gains in moral judgement, as measured by the Defining Issues Test (DIT), correlate strongly with advancing education. Curricula that are strongly biblically based may not promote, and students with a strong fundamentalist orientation may not demonstrate, such moral growth. Students at an interdenominational, but very conservative seminary, completed the DIT before and after ethics courses conducted in three different formats. Those students who spent 30 hours in small‐group discussions of ethical dilemmas improved their moral reasoning scores, while those who had (...) fewer hours of discussion or lectures did not. It would appear that small group discussions, shown to improve moral reasoning scores in other educational settings, are also successful in a strongly biblical environment. (shrink)

Reparations whether to blacks for slavery, or to Indians for land theft, or to settle any number of other conflicts, has an interesting political background. Analysts on the left, who are usually no friend of private property rights, nevertheless rely on this doctrine to support their case for reparations. Those on the right, in contrast, who supposedly defend the institution of property rights, jettison them when it comes to reparations. Esther Reed’s Good Work provides just that: a broader context for understanding the significance of our work.Many people understand “work” to be the energy they expend in order to receive something they can then spend. Such an understanding of work, Reed observes, reflects the assumptions of a capitalist society in which people are valued in terms of what they do and how much money they make. From this standpoint, cardiac surgeons are valued much more highly than garbage collectors, even though societies could not function without garbage removal but did, in fact, survive for centuries before cardiac surgeons. In this article, we shift the usual analytical attention of the GPN framework from lead firms to suppliers in the network and from production to IT services. Our focus is on how Indian IT suppliers embed in the Netherlands along the threefold characterization of societal, territorial and network embeddedness. We argue that Indian IT suppliers attempt to display societal embeddedness when they move to The Netherlands. Our findings reveal that the endeavour by Indian IT suppliers to territorially dis-embed from the (...) Dutch context is reinforced by their peripheral position in the network and their ability to offshore work in a bid to contain costs, in addition to the influence of client domination. Therefore, territorial embeddedness is considered to be secondary to societal embeddedness which is intertwined with client interest while neglecting the interest of other network members. Nonetheless, the inter-firm relationship is complex, given the tension between societal, territorial and network embeddedness. While preferring Indian IT suppliers because of their low pricing, Dutch clients also insist on compliance with the institutional context of the Netherlands especially when it comes to Dutch employees. This results in hybridization which means that Indian IT suppliers find ways to adhere to the institutional framework for Dutch nationals while simultaneously insulating Indian employees from the same. Consequently, a highly unfair segmented internal labour market develops, with Dutch nationals being treated more favourably as compared to Indian nationals. Nonetheless, to address these violations, Indian employees prefer individual strategies of resilience and rework rather than a collectivization response. (shrink)

We say that a sentence A is a permissive consequence of a set X of premises whenever, if all the premises of X hold up to some standard, then A holds to some weaker standard. In this paper, we focus on a three-valued version of this notion, which we call strict-to-tolerant consequence, and discuss its fruitfulness toward a unified treatment of the paradoxes of vagueness and self-referential truth. For vagueness, st-consequence supports the principle of tolerance; for truth, it supports the (...) requisite of transparency. Permissive consequence is non-transitive, however, but this feature is argued to be an essential component to the understanding of paradoxical reasoning in cases involving vagueness or self-reference. Engaging Polanyi’s embeddedness–disembeddedness framework, this study explored the work experiences of Bhil children employed in Indian Bt cottonseed GPNs. The innovative visual technique of drawings followed by interviews was used. Migrant children, working under debt bondage, underwent greater exploitation and perennial and severe depersonalized bullying, indicative of commodification of labour and disembeddedness. In contrast, children working in their home villages were not under debt bondage and underwent less exploitation and occasional and mild depersonalized bullying, indicative of how civil society organizations, (...) along with the state, attempt to re-embed economic activities in the social context. Polanyi’s double movement was evident. ‘Place’ emerged as the pivotal factor determining children’s experiences. A ‘protective alliance’ of community controls and social power, associated with in-group affiliations and cohesive ties, stemming from a common village and tribal identity, aided children working at home for Bhil farmers. ‘Asymmetric intergroup inequality’ due to pronounced social identity and class differences, coupled with locational constraints and developmental disadvantage, made migrant children vulnerable targets. Social embeddedness influences how child workers are treated because it forces employers to be ethical and not engage in bullying. However, by shifting production to children’s home villages, there is an attempt to obscure the difference between child labour and child work. Thus, the seeds of disembeddedness are sown through the very act of re-embeddeding, potentially hampering future interventions. (shrink)

In this hugely influential book, Laclau and Mouffe examine the workings of hegemony and contemporary social struggles, and their significance for democratic theory. With the emergence of new social and political identities, and the frequent attacks on Left theory for its essentialist underpinnings, Hegemony and Socialist Strategy remains as relevant as ever, positing a much-needed antidote against ‘Third Way’ attempts to overcome the antagonism between Left and Right.

How should political power and influence be allocated in democratic systems? That is, roughly, the core of the boundary problem in democratic theory. As of late, some authors have begun paying increased attention to the methodological aspects of this dispute. This paper attempts to make a twofold contribution to this ‘methodological turn’. On the one hand, it identifies and analyzes five desiderata of a successful principle of democratic inclusion. Any such principle, I argue, must be grounded in a clearly identifiable (...) set of values, must provide a clear standard of inclusion, must specify the relevant modalities of inclusion, must provide sound bridging principles, and must be extensionally adequate. In the first half of the paper, these desiderata are developed and critically scrutinized. On the other hand, I also extract three lessons from the previous discussion. First, that a unique answer to the boundary problem (i.e. one grounded in one single principle) is unlikely. Second, that a satisfactory answer to the boundary problem need not necessarily appeal, as some have argued, to distinctively democratic values. And third, that intuitions about political exclusion (i.e. those requiring or permitting the exclusion of some individuals) should be treated with special caution. (shrink)

*Runner-up for the 2021 Royal Institute for Philosophy Essay Prize*: What should we think about ‘acts of conscience’, viz., cases where our personal judgments and public authority come into conflict such that principled resistance to the latter seems necessary? Philosophers mainly debate two issues: the Accommodation Question, i.e., ‘When, if ever, should public authority accommodate claims of conscience?’ and the Justification Question, i.e., ‘When, if ever, are we justified in engaging in acts of conscience – and why?’. By contrast, a (...) third important topic – the Conduct Question, i.e., ‘How should we act, morally speaking, when engaging in acts of conscience?’ – has been mostly neglected. This paper aims to offer concrete guidance for persons wishing to engage in acts of conscience in morally virtuous ways. I argue that such agents are subject to two basic prima facie duties: duties to oneself related to demands of integrity and duties to others related to demands of civility. I explain both duties in detail, arguing with regard to, that in light of what I call ‘the paradox of conscience’, we need to rethink our views about both ‘conscience’ and ‘integrity’; and with regard to, that, building upon Rawls’ ‘duty of civility’, we should embrace at least seven general principles for undertaking acts of conscience in a morally conscientious manner. In this chapter we use methods of corpus linguistics to investigate the ways in which mathematicians describe their work as explanatory in their research papers. We analyse use of the words explain/explanation (and various related words and expressions) in a large corpus of texts containing research papers in mathematics and in physical sciences, comparing this with their use in corpora of general, day-to-day English. We find that although mathematicians do use this family of words, such use is considerably less prevalent (...) in mathematics papers than in physics papers or in general English. Furthermore, we find that the proportion with which mathematicians use expressions related to ‘explaining why’ and ‘explaining how’ is significantly different to the equivalent proportion in physics and in general English. Presentism is, roughly, the ontological view that only the present exists. Among the philosophers engaged in the metaphysics of time there is wide agreement that presentism is intuitive (or commonsensical) and that its intuitiveness counts as evidence in its favour. My contribution has two purposes: first, defending the view that presentism is intuitive from some recent criticisms; second, putting forth a genealogical (or debunking) argument aimed at depriving presentism’s intuitiveness of the evidential value commonly granted to it.

In a series of recent papers Francesco Orilia has presented an argument for the moral desirability of presentism. It goes, in brief, as follows: since the existence of painful events is morally undesirable, presentism, which denies that past painful events (tenselessly) exist, is morally more desirable than non-presentism, which instead affirms that past painful events (tenselessly) exist. An objection against this argument, which has already been taken into consideration by Orilia, is the ugly history objection or radical objection: what really (...) matters in the moral appraisal of a world is the history of it, and since the presentist and the non-presentist versions of our world share the same ugly history, they are morally on a par. This paper aims at corroborating this objection and defending it from Orilia’s criticisms. This will be done by bringing into play various thought experiments and a distinction between relevance (of an event or a fact about the occurrence of an event) to the moral evaluation of a world and moral (and psychological) involvement (in an event or in a fact about the occurrence of an event). “But surely if it's not irrational, it can’t be OCD!” my friend exclaimed, when I told them about the paper Carolina Flores and Brent Kious provided their excellent comments for. In all fairness, my friend is not working in philosophy, or psychiatry, or in psychology. Still, I take their sentiment to be expressive of a widely held view: if you have a certain mental illness, then you must be irrational. Conversely, rationality guarantees mental health; the sane life is the rational (...) life. -/- In my paper, I attempted to complicate this picture. My main line of thought was that if the sane life is the rational life, we do not have a good conception of rationality yet. For, our best theories of rationality fail to capture what is going wrong in some cases of obsessive-compulsive disorder (OCD). Addressing the criticisms raised by my commentators will allow me to clear up some misunderstandings and sketch avenues for further work. (shrink)

This work brings together trends of current thinking - Lacanian psychoanalysis, deconstruction, neo-Hegelianism and political philosophy - to illuminate the question of identity in the contemporary world. It also examines some of the new political identities which have emerged in recent decades.

What place, if any, does love have in Kantian ethics? This chapter is divided into three parts. First, I discuss Kant’s own account of moral versus non-moral love as found throughout his various writings and show how this closely parallels his account of moral versus non-moral friendship. Second, I discuss contemporary Kantian accounts of both friendship and love, highlighting how they go beyond, and in some ways seem to significantly improve upon, Kant’s own views via their appeal to Kant’s Formula (...) of Humanity. Lastly, I discuss the overall merits of what I call ‘Kantian moral love’. I argue that while Kantian moral love might rightly identify, from the moral point of view, how we ought to act and think when loving other people, it fails to provide a complete account of love, crucially leaving out certain key elements from the wide range of loving relationships we find ourselves in, especially romantic love. That is, while Kantian moral love might successfully identify a morally ideal way to love other people, it falls short of capturing the full essence of love—mainly because love is not simply a moral affair but also a matter of the heart. The main purpose of these introductory remarks is to give the reader a sense of Philip Rossi’s philosophical project and its importance. I will then advance an interpretation of what motivates Kant’s commitment to community, and, on its basis, object to Rossi’s views on radical evil –a point which affects how one should conceive the moral vocation of humanity and the role that politics and religion play within it. Purpose This paper aims to provide a non-academic perspective on the research reports of the JICES “Post-Snowden” special edition, from the viewpoint of a privacy advocate with an IT background. Design/methodology/approach This paper was written after reviewing the country reports for Japan, New Zealand, PRC and Taiwan, Spain and Sweden, as well as the Introduction paper. The author has also drawn on online sources such as news articles to substantiate his analysis of attitudes to technical privacy protection post-Snowden. Findings Post-Snowden, (...) the general perception of threats to online privacy has shifted from a predominant focus on commercial threats to a recognition that government activities, in the sphere of intelligence and national security, also give rise to significant privacy risk. Snowden’s disclosures have challenged many of our assumptions about effective oversight of interception capabilities. Citizens’ expectations in this regard depend partly on national experience of the relationship between citizen and government, and can evolve rapidly. The tension between legitimate law enforcement access and personal privacy remains challenging to resolve. Originality/value As a “viewpoint” paper, this submission draws heavily on the author’s experience as a privacy and technology subject-matter expert. Although it therefore contains a higher proportion of opinion than the academic papers in this issue, his hope is that it will stimulate debate and further research. (shrink)

Frost's article advocates for universal models of reading and critiques recent models that concentrate in what has been described as “cracking the orthographic code.” Although the challenge to develop models that can account for word recognition beyond Indo-European languages is welcomed, we argue that reading models should also be constrained by general principles of visual processing and object recognition.
